5. Eligibility

5.1.1. at least 18 (Eighteen) years old or the age of majority in your jurisdiction, whichever is greater,

6. Client Responsibilities

6.1. As a Client of Premier Physical Therapy, you agree to uphold the following responsibilities to ensure the safety, efficacy, and success of the treatment provided. Your active participation and adherence to these responsibilities are essential to the therapeutic process and to receiving the full benefit of the Services. By engaging Our Services, you agree to:

6.1.1 .Accurate and Complete Disclosure:

6.1.1.1. You are responsible for providing Premier Physical Therapy with accurate, truthful, and complete information regarding Your medical history, current health condition, medications, treatments, allergies, and any other relevant details. This includes informing Us of any changes in Your health condition or circumstances that may impact the treatment plan. Failure to disclose relevant information may result in suboptimal treatment outcomes or potential harm.

6.1.2. Compliance with Treatment Plan:

6.1.2.1. You are expected to adhere to the treatment plan, exercises, and recommendations provided by Premier Physical Therapy. This includes following prescribed home exercises, attending scheduled appointments, and using any recommended therapeutic aids as directed. Lack of compliance with the prescribed treatment plan may hinder Your progress and affect the results of the therapy.

6.1.3.Timely Communication:

6.1.3.1. You must communicate promptly with Premier Physical Therapy regarding any issues, concerns, or adverse reactions that arise during or after treatment. If You experience discomfort, pain, or unexpected changes in Your condition, it is Your responsibility to inform Us immediately, so adjustments can be made to Your treatment plan.

6.1.4. Appointment Management:

6.1.4.1. It is Your responsibility to attend scheduled appointments on time. In the event that You are unable to attend an appointment, You must provide at least 24 hours’ notice to cancel or reschedule. Failure to provide sufficient notice may result in a cancellation fee, as outlined in Our cancellation policy. Repeated missed appointments without notice may result in the termination of Services.

6.1.5. Health and Safety:

6.1.5.1. You agree to follow all safety instructions provided by Premier Physical Therapy and to exercise reasonable care during treatment and while performing any prescribed exercises. You acknowledge that physical therapy may involve some risk, including temporary discomfort, and agree to proceed with the Services at Your own risk, in consultation with Our professionals.

6.1.6. Payment Obligations:

6.1.6.1. You are responsible for ensuring that all payments for Services are made in accordance with the agreed fee schedule. Payment is due prior to or at the time of the appointment, unless otherwise agreed in writing. Failure to make timely payments may result in suspension or termination of Services.

6.1.7. Appropriate Conduct:

6.1.7.1. You agree to engage in respectful and appropriate behaviour when interacting with Premier Physical Therapy’s staff and other clients. Any abusive, inappropriate, or disrespectful behaviour towards staff or other clients may result in the immediate termination of Services.

6.1.8. Medical Advice and Referrals:

6.1.8.1. You acknowledge that while Premier Physical Therapy offers professional physical therapy services, it does not provide medical diagnosis or treatment outside of its scope of practice. If You are advised to seek additional medical consultation or a referral to another healthcare provider, you agree to take the necessary steps to follow such recommendations. Premier Physical Therapy is not liable for any adverse outcomes arising from a failure to seek or follow appropriate medical advice.

6.2. By adhering to these responsibilities, you help ensure the effectiveness of the treatment provided and minimize the risk of injury or complications. Your full cooperation is essential to achieving the best possible therapeutic outcome.

7. Booking and Appointments

7.1. Premier Physical Therapy is committed to providing high-quality care and ensuring that all clients can access Our Services in a timely and efficient manner. To facilitate smooth scheduling and management of appointments, the following terms apply to all bookings:

7.2. Appointment Scheduling:

7.2.1. Appointments with Premier Physical Therapy can be booked by phone, email, or through the contact form available on Our Website at www.premierphysicaltherapy.ie. Clients are required to provide accurate and complete information when booking, including their full name, contact details, and any relevant medical history or condition that may affect their treatment.

7.3. Cancellations and Rescheduling:

7.3.1. Clients must provide at least 24 hours’ notice if they wish to cancel or reschedule an appointment. Failure to provide such notice may result in a cancellation fee. No-shows will also be subject to the cancellation fee.

7.4. Confirmation of Appointment:

7.4.1. Upon successful booking, you will receive a confirmation of the appointment by email, phone, or text message, as per Your preferred contact method. The appointment will only be considered confirmed once You have received this communication from Us.

7.5. No-Show Policy:

7.5.1. If You fail to attend a scheduled appointment without prior notice, you will be charged the full amount of the missed appointment. Repeated no-shows or late cancellations may result in the termination of Services or the requirement of pre-payment for future appointments.

7.6. Cancellation Policy:

7.6.1. You may cancel Your appointment by providing at least 24 hours’ notice. Cancellations made with less than 24 hours’ notice may incur a cancellation fee of up to 20Euro or the full cost of the scheduled service. This fee reflects the time and resources reserved for Your appointment.

7.7. Cancellation by Premier Physical Therapy:

7.7.1. Premier Physical Therapy reserves the right to cancel or reschedule appointments due to unforeseen circumstances, including but not limited to staff illness, emergencies, or other operational requirements. In the event of a cancellation initiated by Us, we will make reasonable efforts to inform You as soon as possible and reschedule the appointment at a mutually convenient time without any additional fees.

8. Fees and Payment Terms

8.1. Service Fees: All service fees will be communicated prior to the commencement of services. Payment is required either prior to or at the time of service.

8.2. Late Payment: If payment is not made on time, Premier Physical Therapy reserves the right to suspend or terminate the provision of services until the outstanding amount is settled.

8.3. Refunds: As physical therapy services involve hands-on treatments, refunds are not available once services are rendered. If there is dissatisfaction with the service provided, clients are encouraged to communicate with Premier Physical Therapy to address concerns.

9. Disclaimer

9.1. The Services provided by Premier Physical Therapy are intended to support Your health and well-being, but they do not replace professional medical advice, diagnosis, or treatment. While Our therapists are trained professionals, results from physical therapy treatments may vary based on individual health conditions, and no guarantees are made regarding the outcome of the therapy provided. You acknowledge and agree that any reliance on the information or Services provided by Premier Physical Therapy is at Your own risk, and We shall not be liable for any injury, loss, or damages resulting from Your use of the Services or from Your failure to seek proper medical advice when necessary. Always consult a medical professional before engaging in any form of treatment or therapy if You have any concerns regarding Your health.

10. Limited Liability

10.1. We will exercise reasonable care and skill in the provision of its Services. However, to the fullest extent permitted by law, Premier Physical Therapy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or other intangible losses, arising out of or in connection with the use or inability to use the Services. Our total liability to You for any claim arising out of or relating to the Services provided, whether in contract, tort (including negligence), or otherwise, shall be limited to the amount paid by You for the specific service in question. You agree to indemnify, defend, and hold harmless Premier Physical Therapy, its directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to (i) Your breach of these Terms and Conditions, (ii) Your use of the Services, or (iii) any negligent or wrongful act or omission by You in connection with the use of the Services. This indemnity obligation shall survive the termination or expiration of these Terms and Conditions.

Upon request, clients may access, amend, or request the deletion of their personal data, subject to legal obligations that may require data retention.

14. Intellectual Property

14.1. All content on the Premier Physical Therapy website, including text, graphics, logos, and images, is the property of Premier Physical Therapy and is protected under applicable intellectual property laws. Unauthorized use, reproduction, or distribution is prohibited without the express written permission of Premier Physical Therapy.

15. Force Majeure

15.1. We shall not be held liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government regulations, strikes, pandemics, epidemics, power failures, or any other event that could not have been reasonably anticipated or controlled (“Force Majeure Event”).

15.2. In the event of a Force Majeure Event, Premier Physical Therapy’s obligations shall be suspended for the duration of the event, and We will make reasonable efforts to notify You and reschedule any affected Services. If the Force Majeure Event persists beyond a reasonable period, either party may terminate the agreement without liability.

16. Termination of Services

16.1. We reserve the right to refuse or terminate services if a client breaches these Terms and Conditions or if, in the therapist’s professional judgment, the client’s condition does not warrant further treatment. Premier Physical Therapy may also terminate services if a client exhibits inappropriate behaviour or fails to meet payment obligations.

17. Dispute Resolution

17.1. In the event of a dispute arising from the use of our services, both parties agree to first attempt to resolve the dispute through informal mediation. This involves direct communication between the user and us to reach a mutually satisfactory resolution.

17.2. If mediation fails, the dispute will be resolved through binding arbitration. The arbitration will be conducted in accordance with the rules of applicable law and jurisdiction. The proceedings of arbitration shall be in the English language. The arbitrator’s award shall be final and binding on the Parties.

17.3. Users will be required to submit their dispute to arbitration by providing a detailed written description of the issue. We will also present our case. The arbitrator will review all evidence and make a decision based on the merits of the case.

17.4. In addition, we shall be entitled to an interim injunction, restraining order or such other equitable relief as a court of competent jurisdiction may deem necessary or appropriate to restrain users from committing any violation of these Terms and conditions.

18. Governing Law

18.1. These Terms and Conditions are governed by and construed in accordance with Irish law. Any disputes arising from these terms shall be resolved in the courts of Ireland.
